Well, what does this news about the Opie & Anthony deal do to CBS’ suit against Howard Stern, which complains about him promoting satellite radio even after they’d allowed it:
For three hours each weekday, Opie and Anthony would do a cleaner version of their usual show — one acceptable under broadcast standards — for the CBS audience, produced in the Midtown Manhattan studios of WFNY (92.3 FM), a CBS station. That portion of the show would also be heard on XM.After that show, the two hosts — whose real names are Gregg Hughes and Anthony Cumia — would travel to XM’s studios nearby for two additional hours of the show, unrestrained. As part of the deal, Opie and Anthony would be allowed to use the end of the CBS show to plug their satellite program, said the executives, who were granted anonymity because the negotiations are still under way.

It’s official.
DLR says that he learned on the car ride home yesterday that today would be his last day on the 92.3 free fm.
He also says that he retained Stern’s lawyer to make his case to the suits this afternoon. Dave mentioned that he’ll try to do his show on Sirius.
He claims that they shut down the email and phone calls for this morning’s show.

2 Quarters - that is how long it is going to take for Sirius to pass XM in subscribers.
The quickest way to convince former Stern listeners on the fence about getting Sirius is to show them their alternatives. Next smart move for CBS - buyout XM.
BTW - Carolla and Rover are bringing in no ratings either. CBS killed radio.

I agree with Joe. CBS killed radio. I sent the link about Roth being kicked to my friends father…he was estatic about the news.
Personally, I could care less who does the talk radio on “Free FM”. I just want my rock music back.

i think CBS knew it wasnt much of a lawsuit in the first place.
just like how their radio division isnt much either
just like how O&A are certainly no heirs to the throne.
if CBS was really smart theyd just throw their hands in the air regarding all this Howard Clone crap and just hire Rush or Hannity in the mornings, or better yet Al Franken and put a funny political show on the morning drive while everyone’s pissed at Bush.
but that would take thinking outside the box.

So what did we learn from all of this?
1.) Doing a radio show isn’t as easy as it looks.
2.) Working with David Lee Roth isn’t as easy as it looks.
3.) If terrestrial radio doesn’t start thinking about new ways to nuture and develop talent, Sirius and XM can expect lots of new subscribers in the not-too-distant future.

“the alleged hiding of a subscriber incentive.” Alleged is right. Howard’s deal was in the papers and publicly available. Moonves is an idiot.

Right… but according to the SEC filings:
“We are also obligated to make substantial stock-based incentive payments under the agreement if we significantly exceed agreed upon year-end subscriber targets during the term of the agreement.”
Notice the wording “during the term of the agreement” which in the agreement is stated as January 1, 2006 through December 31, 2010.
Stern was promoting his move on terrestrial stations before this agreement kicked in. Moonves may be an idiot…. but he has a case.
